Pay equity: be vigilant

STAY ALERT:
AUDIT OPERATIONS IN PROGRESS
Each year, under the Regulation respecting the declaration by employers with respect to pay equity in effect since March 1, 2011, employers must complete the Declaration by employers with respect to pay equity (DEMES).
The obligation to produce the Employer Declaration of Pay Equity (EDPE) is distinct from the obligation to carry out a pay equity exercise and evaluate its maintenance.
The Declaration allows the Pay Equity Commission to :
  • find out about the level of application of the Pay Equity Act in Quebec;
  • target its support and audit interventions at companies;
  • target offenders and issue infringement notices of up to $45,000.
Failure to produce the Declaration, under section 115 of the Pay Equity Act, makes the employer guilty of an offence and liable to a fine ranging from $1,000 to $45,000, depending on the number of employees.
